YEDYURAPPA’S POLITICAL CREDIBILITY AT STAKE! ASKED TO PROVE MAJORITY ON 19TH BY 4.00 PM BY THE APEX COURT
The apex court of India has catagorically directed the governor of Karnataka Valabhai Vaju to convene the Karnataka Assembly’s session tomorrow from ten in the morning and ensure that a pro term speaker is appointed and the transparent voting of the law makers takes place at 4 to 5 PM to decide the fate of the incumbent chief minister BS Yeduruppa who’d been sworn in without possesing the requisite majority.
The court has turned down the 15 days time frame of the governor given to the BJP CM to prove his majority and has directed the incumbent CM to prove the same at 4.00 PM on the floor of the Karnataka Assembly where all the 116 law makers of Congress, JD(s) combine, 104 of BJP and two independents would be present.
Acording to the political analyst and senior journalist Umakant Lakhera this would be the second time that the floor test would be done most transparently under the direct monitoring of the supreme court of India and every momentary proceedings would be duly recorded to be later on submitted to the three judge bench of the apex court in India.
Such voting was earlier conducted in Uttarakhand assembly about two years’ ago when the then Harish Rawat government was in disarray after his party’s 11 MLAs had defected to BJP from Congress creatinga constitutinal crisis.
According to Lakhera as per the directive of the supreme court the governor has been directed to appoint a pro term speaker who could be a senior most veteran MLA of the state to impartially and judiciously conduct the election.
It is quite obvious that after the swearing in ofeach n every newly elected lawmaker tomorrow, the respective political parties i.e. the BJP, Congress and Janata Dal (S) will issue whip to their party legislators to ensure that they do not cross floor or vote against the party whip.
In case, any lawmaker abstains from voting or vote’s against the party defying the whip, he or she would be liable for disqualification as MLA under section 10 of the constitution and anti defection law.
The political situation in Karnataka has become extremely precarious n fluid as the ruling party Bhartiya Janata Party which earlier had 15 days time to prove the majority is now left with only a single day’s time leaving no scope for the party to manipulate things as the BJP government in the state is already short of 8 MLAs to reach the 112 mark where as the post poll Janata Dal combine has a strength of 116, four more than a requisite majority.
In case the BJP wins the floor test, which seems to be a distinct possibility it will be prime minister Narendra Modi’s personal victory and in case it loses the floor test it may help the entire non BJP opposition to start a new chapter of credible political unification against Narendra Modi n his party in 2019.
